Terms of Service – THNDR TCG

These Terms of Service constitute a legally binding agreement between you and THNDR TCG. By accessing or using our website and services, you agree to comply with these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the platform.
1. Eligibility
THNDR TCG is intended for users who are 18 years of age or older. By creating an account, you confirm that you meet this age requirement. We do not permit the use of our platform by individuals under the age of 18 for any reason. If we discover that a user is underage, we reserve the right to terminate the account immediately.
2. Account Registration and Responsibilities
To use THNDR TCG’s services, you must create an account and provide accurate, up-to-date information. You are responsible for safeguarding your login credentials and all activities under your account. Impersonation, use of offensive usernames, or misleading information is strictly prohibited. Violations may result in account suspension or termination.
3. Marketplace Structure and Listings
THNDR TCG is a marketplace that facilitates transactions between independent sellers and buyers. We do not take ownership of listed items unless explicitly stated. Sellers must use the platform’s attribute system when listing cards and must upload high-quality front and back images of the actual item for sale. Each card must be displayed individually. Listings that fail to meet these standards may be removed.
4. High-Value Item Verification
Any single card listed at a price of $150 or more must be sent to THNDR TCG for authentication and condition verification. Once approved, the card will be forwarded to the buyer. If the card is found to be counterfeit or not in the condition stated, the transaction may be canceled and the item returned to the seller. This process protects buyers from fraudulent or misrepresented listings.
5. Fees, Payments, and Payouts
Sellers are charged a flat 7% commission on each successful transaction. In addition, a $0.50 fee is added to each order to support platform-wide shipping infrastructure. THNDR TCG does not charge listing fees. Sellers are responsible for setting their own shipping rates. Payouts to sellers are processed only after delivery is confirmed by the buyer or verified via tracking.
6. Shipping and Fulfillment
Sellers must ship all sold items within five (5) business days of order confirmation. All shipments must include tracking information and be packaged securely. Sellers are responsible for ensuring timely and accurate delivery. Buyers should confirm receipt within three (3) days of delivery. If no confirmation is received, THNDR TCG may auto-confirm delivery based on tracking data.
7. Returns, Refunds, and Dispute Resolution
Buyers must initiate any return or refund request within three (3) calendar days of receiving the item. Acceptable reasons for a refund include items that are not as described, wrong items received, or items damaged in transit. Sellers are required to respond to refund requests within three (3) calendar days.
Refunds are not available once an item is shipped unless the item received has a verified issue. It is strongly recommended that buyers record video of the package being opened to support any claims. Refunds for non-delivery will not be granted unless there is video proof of a tampered package or evidence that the seller shipped to the wrong address.
If the dispute is not resolved between the buyer and seller, THNDR TCG will review the evidence and issue a final decision. Sellers are legally required to comply with refund mandates. Failure to do so may result in account suspension, legal proceedings, or collection efforts.
8. Intellectual Property
All content on the platform, including graphics, images, code, and text, is the property of THNDR TCG or its licensors. Users retain ownership of their uploaded content but grant THNDR TCG a non-exclusive, royalty-free license to use this content for operational and promotional purposes. Unauthorized use of third-party trademarks or copyrighted content is prohibited.
9. Acceptable Use Policy
Users must not use the platform for illegal or prohibited purposes, including but not limited to fraud, harassment, impersonation, or the sale of counterfeit items. Any user found in violation of this policy may have their account suspended or terminated without notice.
10. Limitation of Liability
The THNDR TCG platform is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service or error-free functionality. THNDR TCG is not liable for indirect, incidental, or consequential damages arising from the use of the platform, including loss of revenue, data, or business opportunities. Use of the platform is at your own risk.
11. Disputes and Governing Law
All legal disputes relating to THNDR TCG must be resolved under the laws of the State of Indiana, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Indiana for the resolution of any legal matter.
12. Termination
You may terminate your account at any time. THNDR TCG reserves the right to suspend or terminate any user account, with or without notice, for violations of these Terms, fraud, or abuse. Upon termination, your access to the platform will cease immediately, but you will remain responsible for any outstanding obligations.
13. Modifications to Terms
THNDR TCG may revise these Terms at any time. If material changes are made, we will notify users via email or platform announcement. Continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.
